Terms of Service (including SMS / Text Messaging Terms)

These Terms of Service ("Terms") govern your access to and use of www.petfriendsco.com (the "Site") and any purchases made through it, including SMS / text messaging services. The Site is operated by DO Enterprises LLC, doing business as Pet Friends Co. ("we," "us," or "Pet Friends Co.").

By accessing the Site, placing an order, or opting in to SMS messages, you agree to be bound by these Terms. If you do not agree, do not use the Site or the SMS service.

1. Products & Custom Orders

All Pet Friends Co. hats are custom-made with personalized pet artwork. Because each product is made to order:

• Orders cannot be cancelled after 24 hours.
• All sales are final once artwork has been approved. See our Refund Policy for full details.
• We make every effort to display accurate colors and product images. Actual colors may vary slightly due to monitor settings and printing.
• We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent or placed by resellers.

2. Pricing & Payment

• Prices are listed in US Dollars and are subject to change without notice.
• Payment is processed securely at checkout through Shopify Payments, Stripe, PayPal, or other available payment methods.
• You agree to provide accurate and complete billing and shipping information.

3. Shipping & Delivery

Please review our Shipping Policy for processing times, delivery estimates, and related details. We are not responsible for delays caused by carriers, weather, or incorrect addresses provided by the customer.

4. Artwork Proofs & Approval

• After placing your order, you will receive an artwork proof for review.
• You are responsible for reviewing the proof carefully before approving it.
• Once approved, the order goes into production and cannot be modified or cancelled.
• Free revisions are included before approval.

5. Intellectual Property

• All content on the Site — including text, images, logos, designs, and artwork — is the property of Pet Friends Co. or its licensors and is protected by copyright and trademark laws.
• You may not reproduce, distribute, or use any Site content without our written permission.
• By uploading photos for custom orders, you represent that you own or have the right to use those images and grant us a limited license to use them solely for order fulfillment.

6. SMS / Text Message Communications

Program Name: Pet Friends Co. Order Updates & Proof Approval Reminders

Program Description: By checking the SMS consent box at checkout on www.petfriendsco.com or through another explicit opt-in on the Site, you provide express written consent to receive recurring transactional and customer-care text messages from Pet Friends Co. at the mobile number you provide. Messages may be sent using automated systems and may include, but are not limited to:

• Order confirmations and shipping updates
• Artwork proof approval reminders
• Customer service follow-ups

Message Frequency: Message frequency varies based on your order activity (typically 1–4 messages per order).

Cost: Message and data rates may apply depending on your mobile carrier and plan. Pet Friends Co. does not charge for text messages, but your carrier's standard messaging rates apply.

Opt-Out: You may opt out of text messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message and no further texts will be sent unless you re-subscribe.

Privacy: We do not sell, share, or otherwise transfer phone numbers or SMS opt-in data to third parties or affiliates for their marketing or promotional purposes. Phone numbers and SMS consent data are used only for the purposes described in this section and our Privacy Policy.

Carrier Disclosure: Wireless carriers are not liable for delayed or undelivered messages. Supported carriers include AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, and most other major U.S. carriers.

7. User Conduct

You agree not to:

• Use the Site for any unlawful purpose.
• Upload harmful code, viruses, or malware.
• Attempt to interfere with the Site's operation or security.

The Site may contain links to third-party websites or services. We are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk.

10. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, Pet Friends Co., its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products. Our total liability shall not exceed the amount you paid for the product(s) in question.

12. Indemnification

You agree to indemnify and hold harmless Pet Friends Co. and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your breach of these Terms, violation of any law, or infringement of any third-party rights.

13. Governing Law

These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Clark County, Nevada.

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Site after changes constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
